TERMS, GENERAL BOOKING CONDITIONS, OPERATIONAL POLICIES AND COMPREHENSIVE LIABILITY FRAMEWORK
MARLUC PERU – BESPOKE LUXURY EXPERIENCES DESIGNED IN THE PERUVIAN ANDES
TERMS AND CONDITIONS OF USE OF MARLUC PERU DIGITAL CHANNELS
MARLUC SERVICIOS TURÍSTICOS S.A.C., with Tax ID (RUC) No. 20609391716, with legal address at Urb. Amadeo Repetto, Av. Paz Soldán Q-21, District of Santiago – Cusco – Peru, in its capacity as a Travel and Tourism Agency, is committed to the privacy and well-being of its clients; for such reasons and in compliance with the provisions of Peruvian Law No. 29733 – “Personal Data Protection Law” and its Regulations – Supreme Decree No. 003-2013-JUS, as well as Supreme Decree No. 005-2020-MINCETUR, and any complementary, amending and/or related regulations of any nature, has adopted the necessary confidentiality and security measures so that the information provided to us and/or to which we have access remains properly and permanently protected, as detailed below:
NATURE OF THE SERVICE, CONFIGURATION OF THE OPERATING MODEL AND TRUE SCOPE OF THE CONTRACTED EXPERIENCE
Marluc Peru positions itself as a company specialized in the design, planning, and execution of high-end travel experiences, conceived under a comprehensive, personalized, and strategically structured approach. Unlike traditional tourism models, in which standardized packages, predefined routes, and replicable services are commercialized, Marluc Peru develops unique itineraries that respond to a logic of progressive construction, where each element is carefully analyzed, validated, and integrated within a larger system.
The service offered should not be interpreted as the mere provision of tangible components such as transportation, accommodation, or excursions, but rather as a complex service that combines intellectual, technical, logistical, and operational elements. Each program constitutes an experiential architecture that integrates destination knowledge, cultural interpretation, resource management, and the coordination of multiple stakeholders.
From the moment the client establishes contact with the company, even in preliminary stages of consultation or exploration, Marluc Peru initiates an active process of resource investment. This process includes the evaluation of the traveler’s profile, the analysis of explicit and implicit expectations, the interpretation of preferences, as well as the consideration of external variables such as seasonality, service availability, weather conditions, and local regulations.
The client acknowledges that this preliminary work constitutes an essential and indivisible part of the contracted service, and that the economic value of the program is not limited to the material execution of the trip, but includes the entire process of design, planning, structuring, and coordination that makes it possible.
Likewise, the client accepts that the final itinerary is the result of a balance between the ideal proposal and the real conditions of the destination, and that such balance may require reasonable adjustments before or during the execution of the trip.
BOOKING PROCESS, FORMATION OF THE CONTRACTUAL RELATIONSHIP AND NATURE OF PROPOSALS
The booking process at Marluc Peru is conceived as a progressive mechanism that allows the transition from an exploratory phase to a fully binding contractual phase. During the initial stage, the company presents proposals that reflect a technical estimate based on market conditions in force at the time of their preparation.
The client acknowledges that such proposals do not constitute a guarantee of availability nor a contractual obligation on the part of Marluc Peru, since the services involved especially in destinations such as Cusco, Sacred Valley, and Machu Picchu operate under systems of high demand, limited availability, and strict regulations.
In this context, the booking shall only be considered formally confirmed when the following requirements have been simultaneously fulfilled:
- Complete, verified, and accurate receipt of the client’s personal information
- Express, free, and informed acceptance of these terms and conditions
- Effective payment of the corresponding deposit
- Written confirmation issued by Marluc Peru
Until these elements are met, any communication, quotation, or adjustment shall have no binding nature.
The client accepts that delays in formalizing the booking may result in loss of availability, increased rates, or the need to redesign the program under new conditions.
DEPOSIT, ECONOMIC NATURE, LEGAL FUNCTION AND OPERATIONAL ACTIVATION OF THE PROGRAM
The initial deposit required by Marluc Peru, equivalent to thirty percent (30%) of the total value of the contracted program, should not be interpreted solely as a financial advance, but as a structural element within the contractual framework that simultaneously fulfills economic, legal, and operational functions.
From a legal perspective, the deposit represents the concrete manifestation of the client’s intent to formalize the contracting process, transforming a preliminary phase characterized by proposals, adjustments, and evaluations into an execution phase in which reciprocal obligations between the parties are activated.
From an operational perspective, the receipt of the deposit marks the beginning of a series of immediate and irreversible actions executed by Marluc Peru on behalf of the client. These actions are neither theoretical nor deferred, but involve real commitments with third parties, most of which operate under strict non-refundable policies or high penalties.
Such actions include, but are not limited to:
- Confirmation of reservations in high-end hotel establishments operating with limited inventory and restrictive cancellation policies
- Acquisition of railway tickets in exclusive tourist services, with highly demanded and often non-modifiable availability
- Purchase of nominative Machu Picchu entrance tickets, regulated by the Peruvian State, non-transferable and subject to identity control
- Assignment of certified specialized guides, whose availability is limited and whose hiring implies advance financial commitments
- Structuring of private transportation logistics specifically adapted to the designed itinerary
The client acknowledges that these processes involve the immediate use of the deposit and that, consequently, the funds cease to be available for total or partial refund, depending on the execution status of the program.
Additionally, the deposit incorporates the value of the intellectual work carried out by Marluc Peru from the beginning of the relationship, including design, planning, advisory, and management services. This intangible component constitutes an essential part of the service and is not subject to restitution.
In this sense, the client accepts that the deposit is non-refundable in whole or in part, not as a penalty, but as a reflection of real costs incurred and services effectively rendered.
PAYMENT STRUCTURE, CONTRACTUAL DEADLINES AND OPERATIONAL CONSEQUENCES OF NON-COMPLIANCE
The payment structure established by Marluc Peru responds to the need to align the client’s financial commitments with the operational requirements of the providers involved in the execution of the program.
Thirty percent (30%) must be paid as an advance for the contracting of the service and the design of the itinerary, this amount being non-refundable due to factors such as cancellation of services by the client and circumstances beyond the company’s control. The remaining balance, equivalent to seventy percent (70%) of the total value of the trip, must be paid no later than sixty (60) calendar days prior to the start date of the program. This deadline is not arbitrary, but rather responds to specific supplier policies that require advance payments to ensure the continuity of reservations.
In the case of bookings made within this period, the client must pay one hundred percent (100%) of the program at the time of confirmation, due to the operational impossibility of maintaining services without immediate financial backing.
The client acknowledges that compliance with these deadlines does not constitute a mere administrative formality, but rather an essential element for the viability of the trip. Failure to make payments within the established timeframes may trigger a series of operational consequences that directly affect the structure of the program, including:
- Automatic cancellation of services by providers
- Loss of previously negotiated rates under preferential conditions
- The need to reconstruct the itinerary under new availability conditions
- The application of additional charges derived from extraordinary operational work
Likewise, the client accepts that the established deadlines refer to the date on which the funds must be effectively available in Marluc Peru’s bank account, and not the date on which the transfer process is initiated.
Any delay in the receipt of payments may result in the application of a surcharge of up to five percent (5%) of the total program value, intended to cover administrative, operational, and financial costs derived from the restructuring of the trip.
CANCELLATION, OPERATIONAL DISASSEMBLY OF THE PROGRAM AND ECONOMIC BASIS OF PENALTIES
The cancellation of a travel program designed by Marluc Peru cannot be interpreted as the simple cancellation of an isolated reservation, but rather as the interruption of an integrated system previously structured, which has been developed through the progressive coordination of multiple interdependent services.
From the moment the booking is confirmed and the deposit is received, Marluc Peru initiates a chain of contractual commitments with various providers hotels, transportation operators, specialized guides, regulatory entities, and access platforms whose contracting terms, in most cases, include restrictive cancellation conditions, high penalties, or the impossibility of recovering committed amounts.
In this context, cancellation by the client generates a direct impact not only on the organizing company, but also on the network of services that have been secured on their behalf. For this reason, the cancellation policy has been structured under a principle of progressive proportionality, in which penalties increase according to the degree of execution of the program and the proximity to the travel start date.
The applicable conditions are as follows:
- Cancellations made more than sixty (60) calendar days prior to the program start date: thirty percent (30%) of the total trip value will be retained, corresponding to the initial deposit and costs already incurred during the planning and service securing phase.
- Cancellations made between sixty (60) and forty-six (46) calendar days prior to the start date: fifty percent (50%) of the total program value will be retained.
- Cancellations made between forty-five (45) and thirty-one (31) calendar days prior to the start: seventy-five percent (75%) of the total value will be retained.
- Cancellations made thirty (30) calendar days or less prior to the start: one hundred percent (100%) of the contracted program value will be retained.
The client acknowledges that these penalties do not constitute an arbitrary sanction or punitive measure, but rather economic compensation for real, direct, and indirect costs already assumed by Marluc Peru, including payments to providers, administrative expenses, and costs related to management, design, and planning.
Likewise, the client accepts that once the trip has commenced, the entire cost structure is considered executed; therefore, no partial or total refunds will be granted for unused services, regardless of the reasons that motivate such decision.
CLIENT MODIFICATIONS AND COMPREHENSIVE ITINERARY RECONFIGURATION
Any request for modification by the client, once the program has been confirmed, necessarily implies an intervention in a complex operational structure in which the different components of the trip are closely interrelated.
A change in dates, services, routes, or participants should not be understood as an isolated variation, but rather as an alteration that may generate cascading effects across multiple elements of the itinerary, including accommodation availability, transportation logistics, activity scheduling, staff allocation, and previously negotiated rate conditions.
Consequently, each modification request triggers a comprehensive review process by Marluc Peru, which includes:
- Verification of updated availability across all affected services
- Renegotiation with providers under new conditions
- Logistical reconfiguration of the itinerary
- Recalculation of the total program cost
For this reason, a minimum administrative fee of USD 100 per person will apply, intended to cover the operational and management work required by the requested modification. This fee does not include fare differences or penalties imposed by third parties.
The client acknowledges that any modification may result in an increase in the total program price, as well as the loss of previously secured conditions.
Likewise, if the modification involves the partial cancellation of previously confirmed services, the corresponding penalties will apply in accordance with the policies of the involved providers.
FORCE MAJEURE AND ABSOLUTE OPERATIONAL LIMITATIONS
Marluc Peru acknowledges that, despite meticulous planning, the very nature of travel especially in destinations such as the Peruvian Andes implies coexistence with external factors that are entirely beyond human, operational, and business control.
In this context, Force Majeure shall be understood as any extraordinary, unforeseeable, unavoidable circumstance or circumstance beyond the reasonable control of Marluc Peru that prevents, delays, alters, or renders impossible the total or partial execution of the contracted program.
Such circumstances include, but are not limited to:
- Natural phenomena: heavy rainfall, landslides, mudslides, floods, snowfall, earthquakes, extreme weather variations
- Social factors: strikes, road blockades, demonstrations, civil unrest
- Government decisions: access closures, restrictions to archaeological sites, sanitary regulations
- Health situations: epidemics, pandemics, quarantines, collective medical emergencies
- Technical or logistical issues: flight cancellations, overbooking, mechanical failures in transportation
The client acknowledges that under such circumstances, Marluc Peru will act with professional judgment, operational expertise, and strategic approach to:
- Immediately reconfigure the itinerary
- Substitute services with equivalent or similar alternatives
- Prioritize safety, integrity, and continuity of the experience
However, the client accepts that:
- The exact execution of the original itinerary is not guaranteed
- No financial compensation will be generated for alterations arising from force majeure
- Additional costs resulting directly from such events may be transferred to the client
Likewise, Marluc Peru shall not be responsible for personal expenses incurred by the client outside the company’s control, including but not limited to international flights, insurance, external reservations, or any independently contracted service.
CONTRACTUAL LIABILITY AND TRUE SCOPE OF THE DESIGNED EXPERIENCE
Marluc Peru conceives each journey as a carefully structured work, in which multiple actors, services, and strategic decisions converge to enable a seamless, coherent, and meaningful experience. However, the client acknowledges that, although the company assumes a central role in the conception, design, and coordination of the program, not all elements of the trip are directly executed by it.
Indeed, a significant portion of the services that make up the itinerary such as accommodations, transportation, specialized experiences, and regulated access—are provided by independent third parties operating under their own standards, policies, and regulatory frameworks. Marluc Peru, in its role as curator and integrator of the experience, carefully selects these providers, prioritizing quality, reliability, and alignment with the brand’s service philosophy.
However, the client understands that this rigorous selection does not equate to absolute control over the direct operation of such services. There are variables inherent to the dynamics of the destination, the internal management of each provider, and external factors that may influence the final delivery.
Therefore, the client accepts that Marluc Peru’s responsibility is limited to the proper structuring, coordination, and support of the program, without extending to situations arising from acts or omissions of third parties, unforeseen events, or conditions beyond its reasonable control.
This limitation does not diminish the company’s commitment to excellence, but rather clearly defines the real scope of its role within a complex operational ecosystem.
TRAVEL INSURANCE AS AN INTELLIGENT EXTENSION OF THE EXPERIENCE
In the context of tailor-made journeys, where each component has been carefully selected and coordinated, travel insurance should not be understood as an accessory element, but as a strategic extension of the experience itself.
Marluc Peru emphasizes that, just as one invests in quality, comfort, and design, it is equally essential to invest in protection. The nature of the trip which may involve travel across varying altitudes, interaction with changing environments, and coordination of multiple services entails a level of exposure that must be managed preventively.
The client acknowledges that comprehensive insurance not only protects their financial investment, but also ensures an efficient response to contingencies that could affect the development of the program. Unexpected cancellations, trip interruptions, medical emergencies, or extraordinary logistical situations can be addressed more effectively when adequate coverage is in place.
In this regard, the absence of insurance not only increases the client’s financial risk, but also limits response options in the face of unforeseen situations. Therefore, the client accepts that the responsibility for securing such coverage lies solely with them.
THE DESTINATION AS A LIVING EXPERIENCE AND THE NEED FOR TRAVELER ADAPTABILITY
Traveling to the Peruvian Andes does not simply mean moving from one place to another, but entering a living territory where geography, climate, culture, and history constantly interact.
Marluc Peru designs experiences that aim precisely to connect the traveler with that authenticity, avoiding artificialization of the destination. However, this authenticity also implies accepting that not everything can be controlled or standardized under external parameters.
The client acknowledges that conditions such as altitude, climate variability, the characteristics of local infrastructure, and the natural rhythms of the environment are inherent parts of the journey. These variables do not represent service failures, but natural expressions of the destination.
Consequently, the traveler assumes an active role within the experience, committing to adapt with openness, judgment, and willingness. This adaptability is not only a practical necessity, but also an essential condition for experiencing the journey in its true dimension.
PERSONAL INFORMATION AS AN OPERATIONAL TOOL AND SHARED RESPONSIBILITY
The proper execution of a high-precision journey requires accurate, complete, and timely information. In destinations such as Peru, where certain access points such as entry to Machu Picchu are strictly regulated, the accuracy of personal data is not an administrative detail, but a critical requirement.
Marluc Peru requests personal information solely for the purpose of ensuring proper reservation management, access coordination, and logistical execution of the program. This information allows coordination with providers, compliance with local regulations, and ensures that each element of the journey unfolds without disruption.
The client acknowledges that omission, delay, or inaccuracy in the information provided may generate direct consequences, including the loss of non-refundable services or the inability to access certain destinations.
In this sense, responsibility for the accuracy of the data is shared, with the client guaranteeing that the information provided faithfully matches their official documents.
LEGAL FRAMEWORK, JURISDICTION AND NATURE OF THE AGREEMENT
This document not only establishes operational conditions, but also defines the legal framework governing the relationship between the client and Marluc Peru.
Both parties acknowledge that the agreement is governed by the laws of the Republic of Peru, understanding that the journey takes place primarily within its territory and under its regulations.
Any dispute that may arise shall be interpreted in light of this legal framework, always prioritizing a solution consistent with the nature of the contracted service.
The client accepts that the competent jurisdiction shall be that of the city of Cusco, waiving any other jurisdiction that may correspond to them.
ACCEPTANCE AS A CONSCIOUS ACT AND CLOSURE OF THE AGREEMENT
The confirmation of a journey with Marluc Peru is not an automatic or merely transactional act. It is, in essence, a conscious decision to participate in an experience designed under principles of exclusivity, precision, and depth.
By accepting these terms, the client acknowledges not only the contractual conditions, but also the philosophy behind the service: a balance between control and adaptability, between planning and reality, between expectation and experience.
This document, in its entirety, constitutes the foundation upon which the relationship between both parties is built. It is not merely intended to establish limits, but to align expectations, define responsibilities, and ensure that the experience unfolds with the clarity, transparency, and coherence that characterize Marluc Peru.
